In October, a jury found him guilty of second-degree murder and gross vehicular manslaughter despite evidence that showed that he might not have been the driver. In arguing for a new trial, Riordan reiterated the defense argument that the driver’s severe injuries (the individual that died) clearly placed him on the driver side of the vehicle, which sustained much worse damage than the passenger side.
Riordan also argued that even if Moon had been the driver, he did not act with "implied malice" and a conscious disregard of human life. The young men were only having fun by trying to "get some air" on Bell Road, Riordan said.
"There has never been a California vehicular murder conviction returned on as sparse an evidentiary basis as was provided the jury in this case," Riordan wrote. "Here, there is not a shred of evidence that either Billy Moon or Stewart Shapton was thinking about the possibility of their dying or their killing someone else."
