The offense of DUI or DWI requires more than merely drinking and driving a car. In
Chicago, the law states that an individual must be impaired to the extent that they cannot operate a
car safely. An experienced Chicago DUI
attorney can investigate the process and issues resulting in the DUI charge and can defend those
who were wrongly arrested and charged for DUI.
For instance, people have been detained and even arrested for drunk driving by the police because of the smell of alcohol. Though this does seem bad, it does not disclose how much was consumed, when it was consumed, or the alcoholic content of the beverage consumed. Remember, it is only illegal to consume more than the legal limit and operate an automobile.
Also many Field Sobriety Tests (FST's) do not account for physical abilities of the defendant. These random unfair physical routines do not constitute one’s skill in driving a car. Juries can recognize and understand that physical agility suffers when you are nervous and forced to perform roadside calisthenics.
Furthermore, the accuracy and reliability of chemical testing can be investigated. A DUI lawyer can obtain the calibration records, maintenance history, and accuracy checks of the machine that was used. There is a lot of evidence against the true performance of these machines, and their results may be excluded if were problems in any of these areas.
Finally, the police report can contradict
other evidence in the case. A trained drunk driving attorney in Chicago can point out the many inaccuracies and
understand the inaccuracies of justice and the unfair punishments for those accused of drunk
driving.
