Could I be facing jail time for Petty Theft

I received a Notice To Appear yesterday for $35 in Petty Theft charges. I'm 18 and have a clean record. I've never stolen anything in my life and I feel awful about it.

Jail is very unlikely.  A first time petit theft carries the possibililty of jail, but without aggravating circumstances it is unlikely.  Of course it always depends on the Judge assigned and that depends on what county it occurred in. So, I would call a criminal defense attorney in the county this is in and discuss it with him or her.  Usually this consultation is free.
