In many cities around the country, photo speed cameras have been popping up everywhere. As a huge source of new revenue for the cities, they are an attractive way for municipalities to collect money from citizens. A virtual cash machine at the intersections of major roads, they have been very controversial from the day they came out. But many feel they are unreliable and not fair. Maricopa County Attorney Andrew Thomas is one of them.
He recently announced that his office will not prosecute people for criminal speeding based on photo radar readings. Various jurisdictions throughout Maricopa County and the greater Phoenix area use speed cameras to cite speeders.
Mr. Thomas says, “There is no opportunity to question or cross-examine the camera”, which echoes what other attorneys have been saying for years, all over the country. Many feel it’s a form of entrapment and that the radar machines are faulty.
Will Mr. Thomas’s comments start a new trend for law enforcement all over the country? Time will tell. Thousands of people feel that machines should not be used as evidence against those who are facing criminal prosecution.
It was noted in a recent article regarding DUI cases, dui in phoenix, that many jurisdictions rely on the Intoxilyzer line of breath test machines, manufactured by a company that refuses people the chance to examine the inside of the machine.
