A recent San Jose Mercury
News article revealed what it termed an "unsettling disparity" in the outcomes of those
who chose to be represented by a San Jose Criminal Defense Attorney and those who instead
represented themselves. The December 30th, 2009 newspaper article revealed a startling
disparity in the outcome of 246 resisting arrest cases that were resolved since January 2008.
The outcome depended in large part upon whether the defendant was represented by a San Jose Criminal Defense Attorney. More than half of the defendants appeared without a lawyer. Almost nine in 10 defendants who represented themselves pleaded guilty or no contest to the resisting arrest charge — commonly at the first arraignment. In contrast almost half of those who were represented by San Jose Criminal Law Attorney had their charges eventually reduced or dismissed altogether according to this recent study.
