The answer to this question in California has already been settled, the case of People Vs. Watson
established the so called Watson Murder rule in the context of criminal prosecutions. Though
it can be filed and charged as murder, should it be in every case. Clearly, the act of driving
while intoxicated is a reckless act, does it constitute the requisite intent for second degree
