The answer to this question in California has already been settled, the case of People Vs. Watson established the so called Watson Murder rule in the context of criminal prosecutions.  Though it can be filed and charged as murder, should it be in every case.  Clearly, the act of driving while intoxicated is a reckless act, does it constitute the requisite intent for second degree murder?  We will see more of these prosecutions in the future and I encourage comments on the topic....
