Sexting occurs when a sexually provocative image is sent or received by a cell phone text message. If the receiver is a minor, a crime may have occurred. California Penal Code sections 288.2 prohibits sending a message to a minor if the message is intended to arouse or seduce the minor. The prohibition can apply to sexts or provocative text messages, emails, letters phone calls and any other form of communication. Section 288.2 can be charged a felony or misdemeanor and result in a sentence of up to three years in prison. If an individual is convicted of a felony violation of Penal Code section 228.2, the defendant may be ordered to register as a Sex Offender pursuant to Penal Code section 290.
